WARRANTY DISCLAIMER

Southern Pool Solutions, LLC warrants its leak detection findings for 30 days, minor repair work for 30 days, and major repair work for 1 year from the date of the invoice unless otherwise stated in writing. All warranties apply only to the specific work described in writing by Southern Pool Solutions, LLC.

There are no other warranties, express or implied, including any warranty of merchantability or fitness for a particular purpose, related to services or products provided by Southern Pool Solutions, LLC.

Southern Pool Solutions, LLC shall not be liable under any legal theory for special, incidental, or consequential damages. We are not responsible for any repairs other than the specific repairs originally performed by us. Costs associated with water replacement, chemicals, landscaping, property loss, or loss of use are not covered.

Southern Pool Solutions, LLC is not responsible for damages caused by:

Hydrostatic pressure
Acts of nature (including storms, lightning, freezing, flooding, tornadoes, hurricanes, hail, etc.)
Previous leaks, prior repairs, or work performed by others
Draining of the pool, liner movement, or vinyl shrinkage
Pool plaster, pool surfaces, or cosmetic conditions
Underground utility lines (fiber optic, gas, electrical, water, etc.)

Pool School Disclaimer

Southern Pool Solutions provides Pool School services for educational purposes only. Pool School is designed to help pool owners better understand their pool equipment, basic water chemistry, and general maintenance practices. Instruction is based on visual inspection and information available at the time of the visit.

Southern Pool Solutions does not guarantee water chemistry results, equipment performance, or the prevention of future issues following Pool School instruction. Pool conditions, equipment age, water quality, weather, and homeowner maintenance practices can affect outcomes.

Pool School does not replace routine professional maintenance, repairs, or manufacturer recommendations. Southern Pool Solutions is not responsible for damage, equipment failure, or water quality issues resulting from improper chemical handling, incorrect application, or failure to follow manufacturer instructions after training.

By participating in Pool School, the customer acknowledges responsibility for ongoing pool operation, chemical use, and maintenance decisions.

MECHANIC’S LIEN WARNING (Georgia General Notice)

Under Georgia law (O.C.G.A. § 44-14-360 et seq.), contractors, subcontractors, laborers, and material suppliers who provide labor, services, or materials for improvements to real property may file a mechanic’s lien against the property if they are not paid. A recorded lien encumbers the property and may result in foreclosure if the debt is not satisfied.

This means that after a legal proceeding, your home, land, or property could be sold by court order to satisfy unpaid obligations—even if you have paid your contractor in full but subcontractors, laborers, or suppliers have not been paid.

To preserve lien rights, certain parties may provide you with a Notice to Owner or Preliminary Notice. This notice is not a lien; it simply informs you that a party has the right to file a lien if unpaid.

A mechanic’s lien must generally be filed within 90 days after completion of the labor or delivery of materials. If a lien has been filed, it can only be removed through a recorded Lien Release signed by the claimant or by court action.

PROTECTIVE STEPS FOR PROPERTY OWNERS

To protect yourself and your property, you may consider:

Requesting a Payment & Performance Bond
A bond guarantees completion of the work or payment for damages. Bonds may cost 1–5% of the contract amount and are typically paid by the customer.
Direct Payment Arrangements
Requiring that payments be made directly to subcontractors or suppliers, or using a joint-control payment system where funds are released as work is verified.
Issuing Joint Checks
Making checks payable to both the contractor and any subcontractor or supplier who has provided notice of their involvement.
Requiring Lien Waivers
Upon making payments, require unconditional “Waiver and Release” forms from subcontractors, material suppliers, and laborers for the portion of work paid for. Do not make final payment until all such documentation is provided and any liens have been released.

Consult an attorney if a mechanic’s lien is filed against your property.

INSPECTION & SERVICE LIMITATIONS

Any inspection performed by Southern Pool Solutions, LLC addresses only components, systems, and conditions that are visible, present, and accessible at the time of inspection. We are not required to move furnishings, debris, equipment, or stored items to gain access.

While the inspection report may reference codes, this is not a code compliance inspection and does not confirm compliance with manufacturer installation guidelines or safety standards. The inspection does not guarantee insurability, longevity, or future performance of any component or system.

Deficiencies may include:

Inoperability
Damage, deterioration, or distress
Water intrusion
Missing components
Improper, unsafe, or unsuitable installation

Some findings may be considered life-safety issues, but this inspection is not a safety certification. Not all hazards can or will be identified.

This inspection does not include leak detection unless explicitly noted in writing.

LIMITATION OF REPORT USE

This report is the exclusive property of Southern Pool Solutions, LLC and the named client. Use of the report by any third party is strictly prohibited. All observations and opinions in the report supersede any verbal statements made before, during, or after the inspection.

Southern Pool Solutions, LLC is not responsible for work performed after the inspection that conceals, alters, or modifies any findings.

Service recommendations included in this report should be addressed promptly to maintain proper operation and prevent further damage.
